Privacy Policy

Opinomix Solutions Limited (“Opinomix,” “the Company,” “we,” “us,” or “our”) provides this Privacy Policy to describe our practices concerning the collection, use, disclosure, and protection of personal information gathered through opinomix.com (the “Site”). This Policy has been prepared in accordance with the Privacy Act 2020 (New Zealand) and the Information Privacy Principles (“IPPs”) set out therein.

By using the Site, you acknowledge that you have read and understood this Policy. If you do not accept its terms, you should refrain from using the Site.

Part A: Categories of Personal Information Collected

A.1 Information Provided Directly

Where a visitor submits an enquiry through the Site’s contact form, or otherwise initiates correspondence with Opinomix by email, we may collect the visitor’s name, email address, and the substantive content of any message submitted.

A.2 Information Collected by Automated Means

In the course of ordinary Site operation, certain technical information is collected automatically, including Internet Protocol (IP) address, browser type and version, operating system, device identifiers, and records of pages visited. This information is collected in aggregated and non-identifying form through Google Analytics for the purpose of understanding Site usage.

A.3 Cookies

The Site employs cookies and comparable technologies for the purposes described in Part D of this Policy.

Part B: Purposes of Collection

Personal information is collected and held by Opinomix solely for the following purposes, consistent with the collection limitation and purpose specification requirements of IPPs 1 through 3:

  1. to respond to enquiries submitted via the Site;
  2. to maintain, administer, and improve the Site and its underlying services;
  3. to safeguard the security and integrity of the Site, including the detection of automated or fraudulent submissions;
  4. to comply with applicable legal, regulatory, or governmental obligations.

Opinomix does not collect personal information for purposes beyond those enumerated above.

Part C: Disclosure of Personal Information

Opinomix does not sell, rent, or trade personal information to third parties. Disclosure of personal information is limited to the following circumstances, consistent with IPP 11:

C.1 Engaged Service Providers

Opinomix engages certain third-party providers to deliver and support the Site. These providers act under contractual confidentiality obligations and process personal information solely to the extent required to perform their designated function. Current providers include:

  • Hosting and infrastructure: Netlify
  • Security and bot-verification services: Cloudflare
  • Site analytics: Google Analytics

C.2 Legal and Regulatory Disclosure

Opinomix may disclose personal information where required to do so by law, by a court or tribunal of competent jurisdiction, or in response to a valid governmental or regulatory request.

C.3 Corporate Transactions

In the event of a merger, acquisition, restructuring, or sale of all or substantially all of Opinomix’s assets, personal information may be transferred to the acquiring or successor entity, subject to equivalent protections.

Part D: Cookies and Tracking Technologies

The Site uses cookies to support core functionality and to enable the analytics described in Part A.2. These cookies are not used for behavioural advertising, and Opinomix does not operate or participate in any third-party advertising network. Visitors may disable cookies through their browser settings; doing so may limit certain Site functionality.

Part E: Security of Personal Information

Opinomix maintains technical and organisational safeguards reasonably designed to protect personal information against unauthorised access, use, alteration, or disclosure, in accordance with IPP 5. No method of electronic transmission or storage, however, can be guaranteed as entirely secure.

In the event of a privacy breach that has caused, or is reasonably likely to cause, serious harm, Opinomix will notify the Office of the Privacy Commissioner and any affected individuals in accordance with the notification obligations under the Privacy Act 2020.

Part F: Retention of Personal Information

Personal information is retained only for the period reasonably necessary to fulfil the purposes described in Part B, or as otherwise required or permitted under applicable law, in accordance with IPP 9. Thereafter, such information is securely deleted or de-identified.

Part G: Overseas Disclosure

Certain service providers referenced in Part C.1 may store or process information outside New Zealand. Where personal information is disclosed to a recipient outside New Zealand, Opinomix takes reasonable steps to ensure that the information will be subject to protections comparable to those under the Privacy Act 2020, as required by IPP 12.

Part H: Rights of Individuals

Under the Privacy Act 2020, an individual is entitled to:

  1. request confirmation of, and access to, personal information Opinomix holds about them (IPP 6);
  2. request correction of that information where it is inaccurate, incomplete, or out of date (IPP 7).

Requests may be directed to Opinomix using the contact details set out in Part K. Opinomix will respond within the statutory period of 20 working days.

Where an individual is dissatisfied with Opinomix’s handling of such a request, or with any other matter addressed in this Policy, that individual may lodge a complaint with the Office of the Privacy Commissioner:

Part I: Children

The Site is not directed at children, and Opinomix does not knowingly collect personal information from children without the consent required by applicable law.

Part J: Amendment of this Policy

Opinomix may revise this Policy from time to time. Material changes will be reflected by an updated effective date at the head of this document. Continued use of the Site following any such revision constitutes acceptance of the amended Policy.
